If the elected government of these people is waging undeclared war, then no, there is no overkill in war. Force is to be answered with overwhelming force at all times. Hamas performs acts of war, then they need to taste war to see if that's what they really wanted.

What they wanted was asymmetric warfare. But not *that* asymmetric. :-)

What they wanted was "we do anything we want, then hide among civilians...then if you should somehow manage to catch us we want to be treated as if we weren't violating the law of war".

Then shouldn't they be treated as prisoners of war? Israel says they will be prosecuted as civil criminals.

The peoblem is that they are elected officials. After Israel's independence, a number of their top officials were former members of the army and resistance. Once Israel became a nation, this indemnified them against the British coming in an arresting them.

The only acting leader of a sovereign nation arrested by an external nation without a civil war or conventional war is Noriega.

The question of course is whether or not the Palastinian autorities are recognized by the UN as a legitimate government.

A most interesting sidebar. For example, when Taylor was arrested in Nigeria, then would he also qualify? I find it rather amazing that only Noriega meets that criterion. And I have long been surprised that no one questions the legal basis for that arrest. At any rate, can anyone provide exceptions to the statement that Noriega was the only one arrested?
